GENERAL CONDITIONS OF SALE AND DELIVERY
1. General
1.1. The sale and delivery of goods and/or services to be carried out by Global Cooling Ltd. will always be realized in line with the rules of these General Conditions of Sale, unless explicitly agreed in writing by both parts.
1.2. Any amendments to these general conditions of sale and delivery, or to any of its parts, shall only be compulsory for Global Cooling Ltd. if it has signed said amendments in writing.
1.3. Should any of the stipulations planned in these general conditions be null and void, or impossible to carry out, the subsistent stipulations will still be in force.
2. Offers
2.1. When there is no temporal limitation for an offer, the conditions and prices shall be valid for a maximum time span of 1 year. Global Cooling Ltd. shall only be bound to those conditions agreed in writing, accepted in writing by the Buyer, when said acceptation was known by Global Cooling Ltd. and the order is confirmed by Global Cooling Ltd.. The offers from Global Cooling Ltd. shall be subject to changes before the reception of the acceptation from the Buyer. Global Cooling Ltd. is entitled to revoke any offer before the acceptation from the Buyer.
2.2. Any additional provision to the offer shall also be subject to the acceptation in writing from the Buyer, as well as to its confirmation from Global Cooling Ltd..
3. Price and Terms of Payment
3.1. By the delay on the payment for the good or service provided shall, the Buyer shall be declared in default, with no necessary requirement to that respect, and he shall be bound to pay Global Cooling Ltd., at least, the legal interest rate for the owed amount, from its expiry date to its effective payment.
4. Deliveries and Risks
4.1 The deadlines and due dates arranged shall be subject to the previous condition of the clarification of all the details related to the order in a reasonable period, as well as to the compliance on the part of the Buyer of his or her main obligations, and to the obligation to collaborate for the attainment of the due date.
4.2 The choice of the transport company and conditions shall be to the discretion of Global Cooling Ltd., if the parts have not agreed any instructions to that respect.
4.3 In the case that the goods delivered were damaged during transportation, the Buyer is required to present a report of the facts to Global Cooling Ltd. and to the transport company within 4 days after reception of the goods.
5. Domain Reservation
5.1 Global Cooling Ltd. shall retain the property of the products delivered to the Buyer whilst the Buyer has not completely fulfilled his or her payment duties to Global Cooling Ltd. in consideration of the products and/or services provided.
5.2 Any act of special disposition regarding the products, such as pledging or any other guarantee, shall require the consent from Global Cooling Ltd.. The Buyer shall be required to report immediately Global Cooling Ltd. in case that the products delivered subject to domain reservation are embargoed from a third party.
6. Inspection and Claims
6.1 If the Buyer does not communicate thoroughly Global Cooling Ltd. anything against the goods within seven days after receiving it, the latter shall understand that the Buyer received the goods at his or her entire satisfaction, accepting the Buyer that he or she shall no be able to complain, especially about the quantity or quality of the products delivered.
6.2 In the case that the Buyer submitted a justified report within said seven-day period from delivery, Global Cooling Ltd., after the appropriate verifications, shall remove the defective goods and deliver new products to replace them. Instead of delivering replacing goods, Global Cooling Ltd. shall be entitled to correct the defects or pay for the loss of value. In case of replacement of the defective products or price restitution, this shall be done after the return of said defective goods from the Buyer, if Global Cooling Ltd. requires this to be done. The Buyer shall only be able to lodge claims on the basis of legal guarantees it these obligations have not been fulfilled.
6.3 The Buyer shall facilitate Global Cooling Ltd. the verification of the veracity and the range of any claim.
6.4 Global Cooling Ltd. shall not assume any responsibility, although the defects are clearly evident, if the goods have been handled or treated in whatsoever manner, or if said defects are due, as a whole or partly, to an incorrect storage or transport, to an incorrect, negligent or imprudent use of the products, to external causes such as damages caused by water or fire.
7. Protection of Consumers.
7.1. The consumer is entitled to return the products within seven days from receipt date, the contract being rescinded.
8. Limitation of responsibility
8.1 If there is no regulation against what is stipulated here, Global Cooling Ltd. shall only be liable for the damages resulting from breach of contractual or extracontractual obligations in the case of acting with fraud or serious negligence.
9. Patent rights
9.1 Global Cooling Ltd. reserves explicitly the exercise of patent rights which may derive from the products or services delivered to the Buyer.
10. Applicable law and Jurisdiction
10.1 The applicable law shall be the English Law. The parties submit to the courts in England, save those cases in which the law states imperatively another jurisdiction in favour of the buyer who is the consumer.

11.3 All Orders placed before 15:00 will be despatched from our distribution centre next working day if possible. If this is not suitable please indicate on your order the day that you would prefer delivery. Extra charges are applicable for weekend delivery, this will be indicated as you select the day. We are unable to offer Sunday or Bank Holiday deliveries however collection in person from our warehouse is possible if arranged with global Cooling Ltd. prior to the date of collection.
11.4 UK Mainland
For items located at our Lancashire warehouse the delivery charges are generally £ 30.00 + VAT. Items located at other branches or warehouses will be subject to a different rate. Global-Cooling.com indicates the delivery prices subjected to your order
Please note that you will only pay the actual delivery fees, no packing and handling fees will be charged.
We will deliver to the cardholders address unless otherwise instructed in the checkout form. You may be contacted and asked to provide copies of utility bills and/or ID documents in order to prevent fraudulent use of credit cards. As a new customer we will ship to a secondary address only if you can prove your link with this address.
All deliveries will be during normal working hours. Special / urgent deliveries can be arranged at extra-cost on request. Please contact us at sales@global-cooling.co.uk to arrange this quoting your reference number and order number.
VAT (Value Added Tax) is included in all orders processed online except for orders from non-UK EU businesses giving their VAT registration numbers, delivered within EU but outside the UK.
VAT on some products is calculated at 5%, if the product you are purchasing falls in this catagory please contact us to process payment as it cannot be generted by our on line terminal.
12. Easy Fit Returns Policy
12.1 Steps for returning an item:
You will need your order reference number and the details of the item to be returned.
12.2 Please fill this Returns Form. (coming soon)
An return number will be generated and will need attaching along with Global Cooling Ltd's address.
Please affix this on the returned products.
12.3 You must return the item in its original condition, including packaging and obtain proof of return from the carrier.
12.4 We will then review the system and repair or replace with a system from our warehouse, if neither can be offered then a refund shall be credited once your returns are received.
12.5 Any item returned without a return number will not be accepted by our warehouse
12.6 The goods should arrive to us in their original condition. We will not be hold responsible for goods damaged if the return is arranged by the buyer. We will signal such conditions to the buyer and it is the buyer who have to raise the claim with his/her nominated courier.

Our products are sourced from around the world. Every item is selected for its quality and value. In the unlikely event that the product develops a fault it is subject to our Back to Base warranty conditions. *
If the product is faulty, you must return the goods to us at your cost to our factory for repair unless the goods are being returned by the courier because they are damaged. Once the system has been returned it will be tested and checked, if a problem with the equipment has been found then it shall be repaired and returned to you along with issuing a credit for the courier costs you have accumulated. If the product that has returned is tested and the fault was due to installation or operating procedure then both the cost of return to Global Cooling Ltd. and its redelivery to you shall be at your expense.
If the product is damaged it MUST NOT be signed for, as this is acceptance of its condition and will invalidate any claim.
No refund will be issued if the goods are used for rental to another party.
All goods received damaged must be reported in writing (email/fax/letter) within 48 hours of delivery.

We reserve the right to refuse to process an order due to suspected fraud or unauthorized or illegal activity. If such is the case, we may reject your order and refund the payment if any. We also reserve the right to refuse to process any order for any reason where no payment was processed. If you have notified us of a problem with the goods, we will either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question. We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. This does not affect your statutory rights as a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence.
